1. PURPOSE AND LEGAL FRAMEWORK

Yadoct is a digital healthcare infrastructure platform enabling interaction between Patients and licensed Healthcare Providers.

Yadoct acts exclusively as a technical intermediary and does not provide medical services, diagnosis, or treatment.

These Terms are governed by Algerian law, including Law No. 18-07 on personal data protection and applicable healthcare regulations.

2. ACCEPTANCE OF TERMS

By accessing or using Yadoct (web, mobile, desktop, or kiosk), you agree to be bound by these Terms.

If you do not agree, you must stop using the Services immediately.

Continued use after updates constitutes acceptance of revised Terms.

3. ELIGIBILITY AND ACCOUNT CREATION

3.1 Eligibility

The Services are intended for users aged 18 years or older, unless otherwise permitted under local law with guardian supervision.

3.2 Account Registration

Users agree to:

• provide accurate and complete information
• not create false identities
• maintain only one account per individual unless authorized
• comply with identity verification requests

Yadoct may refuse or suspend access at its discretion for security or compliance reasons.

3.3 Account Security

Users are responsible for:

• maintaining confidentiality of credentials
• all activity under their account

4. DESCRIPTION OF SERVICES

Yadoct provides:

• appointment scheduling and management
• telemedicine consultations
• electronic medical records (EMR)
• e-prescriptions
• clinic workflow tools
• queue management systems
• medical reporting tools
• communication and notification systems

4.1 Platform Nature

Yadoct is NOT:

• a medical provider
• a healthcare authority
• an emergency service

All medical acts are performed exclusively by Healthcare Providers.

5. MEDICAL DISCLAIMER

Users acknowledge that:

• Yadoct does not provide medical advice
• Yadoct does not diagnose or treat conditions
• Yadoct does not guarantee medical outcomes

Telemedicine has limitations and may not replace in-person consultation.

In emergencies, users must contact emergency medical services immediately.

6. HEALTHCARE PROVIDERS

6.1 Independent Professionals

Healthcare Providers are independent and solely responsible for their medical practice.

Yadoct does not supervise or control medical decisions.

6.2 Provider Obligations

Providers must:

• hold valid Algerian medical license
• comply with medical ethics regulations
• respect patient confidentiality
• obtain informed consent
• ensure lawful telemedicine practice
• maintain required professional liability coverage

6.3 Provider Responsibility

All diagnoses, prescriptions, and treatments are the sole responsibility of the Healthcare Provider.

7. PATIENT RESPONSIBILITIES

Patients agree to:

• provide accurate medical information
• attend or properly cancel appointments
• respect providers and platform rules
• avoid misuse or fraudulent bookings

Repeated abuse may result in restrictions or account suspension.

8. PROHIBITED USE

Users are strictly prohibited from:

• violating laws or medical regulations
• impersonating others
• unauthorized access attempts
• reverse engineering or scraping
• transmitting malware
• disrupting platform operations
• using the platform for non-medical purposes

9. PAYMENTS AND BILLING

9.1 Patient Access

The patient application is free of charge.

No in-app purchases or subscriptions apply to patients.

9.2 Telemedicine Payments

Payments may be processed via authorized third-party providers (e.g., Chargily Pay).

Important:

• Yadoct does not store payment card data
• Yadoct does not process payments directly
• transactions occur outside the application

9.3 Provider Billing

Healthcare Providers may be charged subscription or service fees via external payment systems.

9.4 Refunds

Refunds depend on provider policies, payment processors, and applicable law.

Yadoct is not responsible for refund decisions unless legally required.

10. MEDICAL LIABILITY LIMITATION

Yadoct is not responsible for:

• medical decisions
• diagnoses or prescriptions
• treatment outcomes
• provider negligence

All medical liability lies with Healthcare Providers.

11. DATA PROTECTION AND CONFIDENTIALITY

Yadoct complies with:

• Algerian Law 18-07
• CNDP regulations
• medical confidentiality obligations

Personal data is processed solely for service operation.

11.1 Data Hosting

Core health data is hosted within Algeria. Limited technical processing may occur via international providers under strict safeguards.

12. THIRD-PARTY SERVICES

Yadoct integrates with external services such as:

• payment processors
• cloud hosting
• SMS/email providers
• video consultation systems
• analytics tools

Yadoct is not responsible for third-party failures.

13. INTELLECTUAL PROPERTY

All platform components are owned by Yadoct or its licensors.

Users retain ownership of their content but grant Yadoct a limited operational license.

14. SERVICE AVAILABILITY

Yadoct does not guarantee uninterrupted or error-free service.

Interruptions may occur due to maintenance, updates, or external failures.

15. INFORMATIONAL CONTENT (QUEUE DISPLAY)

On in-clinic Queue Display screens (the waiting-room slideshow), Yadoct may show its own informational content — for example, prompts to download the Yadoct apps. This is not third-party advertising, and it is not advertising for doctors, clinics, or teleconsultation services. Yadoct does not operate ad networks, does not use advertising identifiers or behavioral tracking, and does not use personal or health data for this content.

16. APP STORE / GOOGLE PLAY TERMS

If you access Yadoct via Apple App Store or Google Play:

• they are not responsible for the Services
• they are third-party beneficiaries of this agreement
• they are not liable for claims related to the app

17. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

Yadoct is not liable for:

• indirect or consequential damages
• loss of data or revenue
• medical outcomes
• third-party actions

Total liability is limited to:

• fees paid in the last 12 months OR
• 50,000 DZD (whichever is higher under applicable law)

18. INDEMNIFICATION

Users agree to indemnify Yadoct against claims arising from:

• misuse of the platform
• violation of Terms
• illegal activity
• content submitted by users

19. SUSPENSION AND TERMINATION

Yadoct may suspend or terminate accounts without notice in cases of:

• fraud or abuse
• security risks
• legal obligations
• violation of Terms

Users may delete their account at any time.

20. MODIFICATION OF TERMS

Yadoct may update these Terms at any time.

Users will be notified via:

• email
• in-app notice
• updated publication date

Continued use constitutes acceptance.

21. DISPUTE RESOLUTION

Governed by Algerian law Exclusive jurisdiction: Courts of Algiers Mandatory 30-day amicable resolution period before litigation

22. GENERAL PROVISIONS

Entire agreement clause applies Severability applies No waiver of rights Assignment allowed by Yadoct Electronic communications are valid English version prevails in case of conflict
